If you took my mother’s notes to my elementary school and high school gym teachers seriously, then you’d be very concerned because there probably was never a sicker kid in the history of the world. Forging my mother’s signature on those notes became routine and my go-to method for avoiding gym class where I was often the last one picked on a team.
I had migraines, root canals, cavities, and sprained elbows, knees, toes, fingers, and every joint in between. I was just getting over viruses, strep throat, hay fever, regular fever, colds, chicken pox (at least 8x), and upset stomachs. I had regular “appointments” with every single specialist you can imagine: optometrists, opthalmologists, allergists, cardiologists, dermatologists, podiatrists, radiologists, gastroenterologists, and lots of orthopedic guys.
And then the follow-up appointments, too.
Although I was a dutiful child and followed each and every rule growing up, this is one arena where I strayed a bit from the truth. Anything to get me out of gym.
Last week I was reminded of those “gym notes” when we had two deals for our listings fall through during the attorney approval contingencies. With all the business terms in place, the attorney review is supposed to be an opportunity for the attorneys to review the contract for its legal sufficiency and to negotiate any legal changes in good faith with the other side. In both instances, my clients simply got a letter disapproving of the contract outright.
When I pressed the other agents, it became clear that their clients were backing out for non-legal reasons; both “personal” circumstances. Well, folks, this is not cool. But as despicable and wrong as it is, unfortunately attorneys in Illinois have this broad power to simply terminate a contract with a terse email saying they disapprove of it.
Although they could get away with it, such backhand tactics can’t blind me from the truth.
Hey,
I’m the guy who weaseled my way out of gym class for 13 years. I know better.
Have a great weekend!

For nearly 25 years, American Blues Theater has treated audiences to a live retelling of the Frank Capra classic in a 1940s radio broadcast tradition, making "It’s a Wonderful Life: Live in Chicago!" the second longest-running holiday play in Chicago! Relive the story of George Bailey – the everyman from small town Bedford Falls whose dreams of escape and adventure were stopped by family obligation and civic duty – who has fallen onto desperate times. Only a miracle can save him from despair. Filled with original music and classic holiday carols and starring Joe Dempsey (above, right), one of Chicago's finest actors, this warm “holiday favorite makes the bell ring every time.” (Chicago Tribune)
