Loyal readers will recall an e-blast from a few years ago when I described a lender had a problem financing a $1.5 million deal because the contract included an (old crappy worthless) grill.
Well, I know you’ve been waiting anxiously for another grill story for the last couple of years, and I’m hoping this will be worth the wait. A couple of months ago, we listed a vintage condo with a fabulous roof terrace with lake views. After a week on the market, we successfully negotiated a deal for the condo very close to the list price (go, Brad Lippitz Group, go!).
Even though no furniture or personal items were part of the negotiated contract (which often happens; see above grill story), during the inspection the buyer’s agent asked if the sellers would leave some of the terrace furniture and the (old crappy worthless) grill for his buyers. Just leave it. Out of the goodness of their hearts. The buyer’s agent (hereinafter “novice buyer’s agent”) felt that the sellers owed it to his buyers because they paid so close to the list price.
Ah, too late for that, pal. (Lesson to novice buyer’s agent: put personal property in the contract if your clients want it included as part of the deal).
Well, the terrace furniture was apparently expensive stuff, and the sellers were not prepared to simply leave it for the buyers, as nice as the buyers may (or may not) have been. But our gracious sellers did say that they would leave the (old crappy worthless) grill for the buyers.
However, a week before closing something extraordinary happened. The damn (old crappy worthless) grill broke. Flames were coming out from one of the knobs when the seller was grilling; there was probably a leak. In order to manage expectations, we reached out to novice buyer’s agent and explained the situation - and to see if the buyers wanted the sellers to pitch the grill prior to closing. And here’s the email exchange which ensued with the novice buyer’s agent:
Him: Before I reach out to my clients, would it be unreasonable to have the sellers take care of getting the barbeque fixed prior to closing?
Him: I’ll let my clients know and see how’d they like to proceed from here.
Him: Buyers will handle barbeque repairs.
As a lawyer, I think I have standing to say that the sellers had no obligation to repair something which they were not even contractually bound to convey. So there: take that, novice non-attorney buyer’s agent!
Inasmuch as this probably whets your appetite for more grill stories, I’m afraid to say this will probably be it for a while. You’ll have to live with other less eventful non-grill-oriented Brad Lippitz Group stories in the meantime.
